Only users whose details have been registered with us by a school will be permitted to use the App.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"7\">\n<li><b><span data-contrast=\"none\"> The data protection laws and principles we honour<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">ProgressTeaching\u00a0is committed to protecting your personal information when you are using the Parent App. We take our written instructions to administer the App and to enable your access to the App from the school.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Whenever you provide such information in the App, we are legally obliged as a data processor to use your information in line with all applicable laws concerning the protection of personal information, including the Data Protection Act 2018 and the General Data Protection Regulation 2016\/670 (\u201c<\/span><b><span data-contrast=\"none\">GDPR<\/span><\/b><span data-contrast=\"none\">\u201d) as the same may be updated or replaced from time to time.\u202f These laws are referred to collectively in this policy as the \u201c<\/span><b><span data-contrast=\"none\">data protection laws<\/span><\/b><span data-contrast=\"none\">\u201d.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">A fundamental feature of the data protection laws is the establishment of guiding privacy principles at Article 5 of the GDPR.\u202f For further information as to how your school applies these privacy\u00a0principles\u00a0please refer to their own Privacy Policy.\u202f\u202f\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">For your information, the service we provide at the request and instruction of the school operates in accordance with these principles including the principles of transparency, purpose-limitation, data accuracy, retention\/storage, data security and integrity, and data minimisation.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"8\">\n<li><b><span data-contrast=\"none\"> Our commitments to you<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">Subject to the bespoke commitments and arrangements put in place by your school as the relevant data controller, we subscribe to the following practices:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"6\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">We do not engage in restricted transfers of personal data save than as permitted by the exceptions and permissions contained in the data protection laws. \u202f We therefore do not currently store or transport personal data outside of the\u00a0EU<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ul>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"6\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">We do not transfer personal data originating from schools in an unencrypted format.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"6\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">We do not claim ownership over any of the data processed or created as part of services provided to you. If you wish to exercise any of your rights under data protection laws to remove any content, more details can be found in the \u2018Rights of individuals\u2019 section below.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ul>\n<ol start=\"9\">\n<li><b><span data-contrast=\"none\"> Authorisation from the school<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">The Parent App is made available to you under clear authorisation provided to us by your school, who act as the primary gatekeeper and data controller in terms of the information held by it in connection with your child.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"10\">\n<li><b><span data-contrast=\"none\"> Your download of the Parent App<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">Your school will provide you with details of how to download our App along with unique\u00a0login credentials.\u00a0From that moment on, you should not allow others to access the App on your phone or other handheld device or tablet upon which the App can be accessed (each a \u201c<\/span><b><span data-contrast=\"none\">Device<\/span><\/b><span data-contrast=\"none\">\u201d).\u202f You should not share your login credentials with anyone even if he or she is a co-parent or fellow legal guardian or fellow teacher of your child.\u202f All parents or guardians with children at schools which subscribe to the\u00a0ProgressTeaching\u00a0services are entitled under the licensing agreement to set up their own profiles. This will then enable them to access the Parent App providing the school has provided them with the relevant authorisation.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"11\">\n<li><b><span data-contrast=\"none\"> \u202fData sources<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">The App may process data about you through:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"7\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">Downloading the App \u2013 when registering your device for the services\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"7\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">Displaying information supplied by the school<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"7\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">Displaying\u00a0content\u00a0you upload using the App<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"7\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">Unique application numbers, reinstallations of the App, other updates or resets<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ul>\n<p><span data-contrast=\"none\">When you want to install or uninstall an App such as the Parent App it may possess a unique application\u00a0number\u00a0or it may search for automatic updates and these processes can supply information about your installation such as the type of operating system your Device is using.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"12\">\n<li><b><span data-contrast=\"none\"> The types of information we collect about you and your child\/pupil<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">The predominant types of data that might be used (but not necessarily cached) in the App include:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">The technical and other information that you give us when downloading and registering the App \u2013 which allows us to validate you as a\u00a0User;\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">The information we get from your day to day use of the App (for example by uploading content, frequency of visits);<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"3\" data-aria-level=\"1\"><span data-contrast=\"none\">Other types of information we process and display which emanate from the MIS controlled by the school (such as your child\/pupil\u2019s attendance record, school reports and achievements)<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"4\" data-aria-level=\"1\"><span data-contrast=\"none\">Messaging services or feedback opportunities or surveys which we may provide from time to time to time on the App (both one-way and two-way traffic);<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"5\" data-aria-level=\"1\"><span data-contrast=\"none\">Special category data where the school is obliged to (and therefore will) obtain your specific consent before processing it \u2013 such as blood group, medical details, and other essential information relating to the vital interests of your child which may include associated information relating to his or her sibling or other family members (particular allergies, medicines, procedures and conditions the school should know about).\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">Technical information relating to how you use the App, which will include information about your Device, its settings, its IP address, and certain permissions within the Device, plus analytics regarding your use of the App \u2013 frequency of usage, what you read, interact with, upload and download; and,<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"8\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">Monitoring information and communications which may be recorded for purposes of quality assurance, training and fraud prevention.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ul>\n<ol start=\"13\">\n<li><b><span data-contrast=\"none\"> Your school\u2019s lawful bases for collecting information about you and your child\/pupil?<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">We have listed a wide range of information-types in the previous section.\u202f Data protection laws requires your school to have a lawful basis (Article 6 (1) of the GDPR) for engaging us to process the types of App Personal Data we hold about you or your child.\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">For the most part your school is obliged to use personal data in respect of you and your child pursuant to\u202f<\/span><b><span data-contrast=\"none\">a legal obligation<\/span><\/b><span data-contrast=\"none\">.\u202f These legal obligations emanate from successive Education Acts (from 1944, 1996, 2002 for example) as well as a vast range of other acts of parliament related to children and childcare in addition to relevant regulations applicable to schools.\u202f For further details please consult your school\u2019s Privacy Policy.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">ProgressTeaching\u00a0is required to help your school process this personal data because of a\u202f<\/span><b><span data-contrast=\"none\">contractual necessity<\/span><\/b><span data-contrast=\"none\">\u202f\u2013 where we need to perform our subscription agreements with each school (which includes provision of the\u00a0platform\u00a0and the App we make available to you through your school).\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">For several\u00a0of\u00a0the information\u00a0types that are accessed in the App,\u00a0there will be occasions when your school will rely on its\u202f<\/span><b><span data-contrast=\"none\">legitimate interests<\/span><\/b><span data-contrast=\"none\">\u202fto justify the processing of that information. Neither you nor your child or individuals connected to your child will be able to be identified from this information.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"20\">\n<li><b><span data-contrast=\"none\"> Offensive or inappropriate content on the Parent App<\/span><\/b><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">If a\u00a0User\u00a0posts or uploads content which is disruptive or may reasonably be deemed to be offensive, objectionable\u00a0or otherwise inappropriate,\u00a0ProgressTeaching\u00a0may remove such content and may deny you access to the Parent App temporarily or permanently as we see fit.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Where\u00a0ProgressTeaching\u00a0reasonably believes that you are or may be in breach of any applicable laws, in respect of hate-speech for example we may disclose your personal information to relevant third parties, including to law enforcement agencies or your mobile phone operator or other internet communications provider.\u202fProgressTeaching\u00a0shall only do so in circumstances where such disclosure is permitted under applicable laws, including data protection law.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol start=\"21\">\n<li><b><span data-contrast=\"none\"> How long will ProgressTeaching keep my information?<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">As a reminder, the Parent\u00a0App only provides a medium for you and the school to update the records your school holds about you and your child. Parent\u00a0App does not cache or store these records. The\u00a0ProgressTeaching\u00a0platform is developed using secure technologies, which include, but are not limited to the following:<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"28\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"none\">All personal and sensitive\u00a0ProgressTeaching\u00a0data is stored and transported within the EU<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"28\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"none\">All external data transmissions to and from the\u00a0ProgressTeaching\u00a0Platform are encrypted using modern SSL\/TLS protocols and ciphers<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"28\" aria-setsize=\"-1\" data-aria-posinset=\"3\" data-aria-level=\"1\"><span data-contrast=\"none\">All servers are situated in secure locations<\/span><span data-contrast=\"none\">.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ul>\n<ol>\n<li data-leveltext=\"%1.\" data-font=\"Arial\" data-listid=\"29\" aria-setsize=\"-1\" data-aria-posinset=\"4\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Staff access to data<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">ProgressTeaching\u00a0does not inspect any of the data we store, except\u00a0where a school has given us permission to inspect their data; for example, to provide technical support to correct a technical problem.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">All our staff are required to agree that they will\u00a0abide by the Security and Data Protection Policy at all times.\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol>\n<li data-leveltext=\"%1.\" data-font=\"Arial\" data-listid=\"30\" aria-setsize=\"-1\" data-aria-posinset=\"5\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Deleting and Retaining Data<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">We retain personal data on our platform for as long as necessary to provide the\u00a0ProgressTeaching\u00a0service. If a school terminates their contract with\u00a0ProgressTeaching, we will delete their personal data within\u00a012\u00a0months.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol>\n<li data-leveltext=\"%1.\" data-font=\"Arial\" data-listid=\"31\" aria-setsize=\"-1\" data-aria-posinset=\"6\" data-aria-level=\"1\"><b><span data-contrast=\"none\">ProgressTeaching\u00a0and\u00a0Third Party\u00a0applications<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">Schools are responsible for accepting the terms and conditions of\u00a0third party\u00a0applications.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Before we allow Third Party Applications to access school data, schools must authorise the requests to connect to their data and review the type of data that an application is requesting. These permissions can be revoked at any time by the school.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<ol>\n<li data-leveltext=\"%1.\" data-font=\"Arial\" data-listid=\"32\" aria-setsize=\"-1\" data-aria-posinset=\"7\" data-aria-level=\"1\"><b><span data-contrast=\"none\">Privacy or Security Breaches<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/li>\n<\/ol>\n<p><span data-contrast=\"none\">We take all reasonable and necessary precautions to ensure that your data is secure and to recognise and then mitigate the risks to security and privacy. However, it is not possible to 100% guarantee the security of any data transmitted or stored electronically.\u00a0In the event that\u00a0a breach of security or privacy did occur,\u00a0ProgressTeaching\u00a0will contact Data Controller of the affected data, and inform the Information Commissioner\u2019s Office (ICO), and other authorities, if required by law.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u202f<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p aria-level=\"2\"><b><span data-contrast=\"none\">Information for students and parents<\/span><\/b><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">ProgressTeaching, as the Data Processor, only has access to pupil data as requested by the school, as Data Controller, and only for the purposes of performing services on a school\u2019s behalf.<\/span><span data-ccp-props=\"{\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Your child\u2019s school remains the Data Controller of any pupil data we process. If you have questions about your or your child\u2019s data or how your school is making use of our service, please contact the school directly.
